Analysis: This bill reorganizes the fee system for the Air Operation Permit Program Fee Trust Fund. It creates a balanced fund that assesses annual fees but only in the amount that is equal to the cost of the Title V program for which the fund is intended. If the fund is endowed with enough money to fully fund the program, no more fees are to be assessed. This balanced fund meets a federal requirement intended to keep the states' environmental protection efforts fully funded. This federal requirement comes with the stipulation that should the states fail to provide an adequate fund structure for certain Title V (clean air) efforts, federal agencies would step in and subject the state to its regulations. This bill puts into place a fair and balanced fund structure for the Air Operation Permit Program Fee Trust Fund and meets a federal requirement that will keep Mississippi in control of its environmental regulations as opposed to the federal agencies.
