Judiciary, Division A

Bill Number Bill Description Bill Status
HB 25
Neutral
MS Electronic Court System; require all courts to utilize. Alive
Analysis:
HB 96
Good Policy
Baby Drop-off Law; revise. Alive
Analysis: This bill changes the definition of "emergency medical services provider" to included fire stations and ambulances that are staffed with full time firefighters or emergency medical personnel. This effectively adds fire stations and staffed ambulances to the list of authorized locations under the "baby drop-off" law. The purpose of this is to increase the number of authorized and monitored locations that a child 3 days or under can be left in order to avoid abandonment of these infants somewhere other than a monitored area.
HB 150
Good Policy
Dentists; provide immunity for providing charitable and emergency services. Dead
Analysis:
HB 273
Good Policy
Municipal judges; authorize to hold court outside municipal boundaries that is more than within a one-mile radius of municipality to accept pleas. Alive
Analysis: This bill allows judges to hold court at locations outside of their municipalities for the purpose of accepting pleas.
HB 493
Neutral
Counties; may also maintain electronic format of law books in courtrooms and in county public law libraries. Alive
Analysis:
HB 576
Good Policy
Livestock on highways; delete burden on owner of livestock to prove lack of negligence when damages from. Alive
Analysis: As it stands, in the event of livestock wandering onto state roads and causing an accident, the burden is on the owner of the livestock to prove that he was not negligent in allowing the livestock to wander onto the road per state law. This is akin to holding that the livestock owner is guilty first, and must prove his innocence. This stipulation violates the principle of "innocent and until proven guilty" and this bill removes that stipulation from state law.
HB 636
Bad Policy
Homeowners' associations; regulate managing agents of and require financial reviews by. Dead
Analysis: This bill needlessly regulates the activities of Homeowner's Associations. This overregulation will cause HOA fees to increase and will generally hinder the ability of HOAs to operate.

Analysis: This bill establishes a procedure by which abandoned mobile or manufactured homes may be sold or disposed of.
HB 1559
Bad Policy
Human trafficking and commercial sexual exploitation; provide services for victims through approved services. Alive
Analysis: This bill provides for the creation of a slew of new government jobs and establishes a new fund for the purpose of providing care to those afflicted by human trafficking and sexual exploitation. While this is a worthy cause, the state government simply does not have any more of the taxpayer's dollars to spend on non-essential functions of government. The private sector offers solutions and care to Mississippians at no expense to the taxpayer. The state government should focus on attacking the criminal activity at the root cause of this issue, not spend tax payer dollars on programs that already operate in the private sector.
HB 1779

Analysis:
HB 1783
Bad Policy
The Mississippi Back to Business Liability Assurance Act; create. Alive
Analysis:
SB 2002
Bad Policy
Wildlife Trafficking Prevention Act; enact. Dead
Analysis: This bill seeks to eliminate the illegal trafficking or sale of 9 distinct animal species. However, the bill gives broad oversight to a state commission to implement a host of legal rules based on little to no evidence of wrongdoing; and includes a “presumption of intent” for wrongdoing. The State Commission on Wildlife, Fisheries and Parks is not a judicial body and should not be in the business of “presuming” wrongdoing, especially under the loose parameters outlined in this legislation.
