Analysis: This bill removes checks and balances currently in place to review all actions in one of the largest budget categories in state government. The Constitution does not obligate the states or the federal government to pay for medical expenses, even for the health care needs of poor persons. *Maher v. Roe, 432 U.S. 464, 469 (1977). See also Youngberg v. Romeo, 457 U.S. 307, 317 (1982). In light of the fact that our state voluntarily chooses to use taxpayer money to pay for health care services of others outside of the proper role of government, it is imperative that every effort is made to eliminate unnecessary spending, increase accountability, and promote individuals’ access to the free market. This bill expands the size of government by re- creating an old commission and granting it sole authority over the multi-billion dollar Medicaid budget similar in nature and function as the existing Board of Education. This bill authorizes inmates in our state’s Department of Corrections facilities to be moved to nursing homes as a mechanism to obtain federal funds, which is also simply taxpayers' money.
